Should you form an LLC for your acting, writing, film maker career?

Usually the answer will be yes.  First what is an LLC.  LLC stands for limited liability company which is a form of business entity usually less onerous than a corporation.  An LLC can be formed in such a way that the liability for its acts will be restricted to the assets of the LLC and therefore protect the personal assets of the members...even if there is only one member.  For example, if you are filming a documentary, the LLC may serve as an added protection for any deficiencies you may have in your release forms, waivers or liability, copyright, patent issues after the documentary, acting, writing, etc. is finished.

From your response, an LLC seems the better choice for actors and entertainers, but I did worry that your personal assets would be liable, so I thought a corporation would be better. However, corporations appear to be under more government regulations and require more filings than an LLC. Is this true? Should entertainers stick with an LLC rather than a corporation, if as you say, the LLC can be constructed to protect the personal assets?

Yes, LLCs have come a long way since they first appeared in Hawaii. An LLC has just as much protections liability wise as a Chapter S-Corporation. There are some basic maintenance strategies used to avoid the LLC being considered merely an alter ego of an individual and tax filing is a breeze compared to a C-Corp. Aloha, JZ.
